Montgomery County, Maryland Food Allergen Awareness Requirements

With over 15 million Americans affected by food allergies, Montgomery County, Maryland, has implemented important measures to improve safety in restaurants and food establishments. These laws are designed to protect individuals from potentially life-threatening allergic reactions when dining out.


Maryland State Food Allergy Poster Requirement

Under Maryland Code Annotated, Health-General § 21-330.2(A), effective March 1, 2014, all food establishments must prominently display a food allergy awareness poster in staff areas.
The poster must include information about the risks of allergic reactions and help staff recognize symptoms and respond appropriately.


Montgomery County Bill 33-16 – Allergen Awareness Training

Effective July 1, 2017, Bill 33-16 requires that all eating and drinking establishments regulated under the Montgomery County Health Code must meet the following condition:

  • A trained employee with valid food allergen awareness certification must be present anytime food is prepared or served.
  • The employee must complete a county-approved allergen awareness training and pass an exam.
  • This applies to establishments under the supervision of a Certified Food Service Manager.

This regulation ensures staff can identify major allergens, prevent cross-contact, and respond effectively to allergy emergencies.
